Terms of Service

Before you proceed to using our site, make sure to read our Terms of Service carefully.
Sign up Obligations
In order to access our services, you need to sign up for a user account. If you represent a company and wish to use our services for internal use only, we recommend you sign up through your corporate email account. By signing up to our services, you agree to:

  • provide accurate and true information about you and the organization you represent
  • update your account while keeping it true, accurate, current and complete. If the information you provide is false, inaccurate, obsolete and incomplete, Flexie has all the power granted by law to terminate your account if there are reasonable grounds to believe that the information you have provided is untrue, inaccurate, outdated or simply incomplete.
Collaboration on Beta Service
By using our site, you understand that we may offer specific services as open or closed beta services. We may offer the client parts of a certain service or complete platforms that are still in Beta phase, something which will help us evaluate the services faster and better, to build the product according to our client’s requirements.

We have the exclusive right to determine the duration of testing and evaluation of our Beta services. If you agree to receive our Beta services, you will be the sole responsible in case of incidents and unpredictable software behavior. Furthermore, Flexie Solutions can, at any time, without prior notification, withdraw Beta products, without losing customer data.
Functionality modifications and removal
In order to improve our products and provide you a better service, we will work continuously on new features. We have the right to modify features in our platform and improve their performance. We also have the right to remove features that, in our judgment, do not offer any added value to your system. Flexie Solutions can do this at any time, without prior notification.
Personal information and Privacy Policy
We take personal information and privacy very seriously, hence we shall make sure that all the information you provide is kept out of reach from advertisers, spamming and other unsolicited forms of advertising, provided that it is true, accurate, current and complete. All the information you provide is governed by Flexie Privacy Policy.

By using our services, you acknowledge and agree with our Privacy Policy. You are solely responsible for keeping your username, your password and other sensitive information confidential. Furthermore, you shall be responsible for any activity that occurs in your user account. If you detect any suspicious activity on your user account, please feel free to contact us. We shall not take responsibility for any damage or loss incurred as a result or unauthorized access to your User account.

Flexie Solutions will also have access to third party personal information provided by you such as email addresses, third party contact names, phone numbers, etc. This information will be used only as part of your use of Flexie Solutions, and it will be not shared for promotional purposes, or for any purpose not explicitly consented by you. We will use personal information to provide you with the services you request. We may use this data to offer you additional information about our services, features, partners, events, and promotions. Flexie Solutions may use personal information to improve our site’s functionality and our services.
Complaints
Any time we may receive a complaint against you from third-party users, we shall forward the complaint to your primary email address so that you can handle the matter properly. You must respond to the complaint at least within 10 days of receiving it from Flexie. Any failure to do so will result in us disclosing relevant contact information about you, so that the plaintiff can take legal action against you. By agreeing with our Terms of Service, you acknowledge that any attempt to avoid dealing with complains against you is a breach of our Terms, and therefore, you shall be held solely responsible for any consequence.
Restrictions
An integral part of our Terms of Service are certain restrictions. By accepting our Terms of Service, you shall not: a) transfer Flexie and its services to any concerned third party; b) use third party links without accepting their Terms of Service; c) provide third party services of Flexie without prior written permission; d) share or publish personal information that belongs to any company or individual without their consent; e) use Flexie services in a way that could damage or incur loss to our servers, network, computer service and other resources; f) use Flexie logo and other third party logo’s without prior written permission; g) create fake identities to mislead any entity or company involved. The aforementioned restrictions apply to any continent, country, state, region or city.

We are very keen on data security. While we highly appreciate your help in discovering and reporting to us vulnerabilities in our system, the following behavior is prohibited:

  • Getting access, or tying to access, information that doesn’t belong to you
  • Devise and launch any kind or electronic or physical attack on Flexie Solutions staff, data centers or property
  • Getting involved in actions that may harm Flexie such as web crawling, spamming, using brute force to extract sensitive information, etc
  • Any attempt to destroy or corrupt data that doesn’t belong to you
  • Performing vulnerability tests on our system
  • Breach or violate any law so as to discover security vulnerabilities within our system
Prohibited content
Flexie CRM is very inclusive and provides service to different business fields and domain. However, there are some guidelines for the content that is prohibited. Categories of such content include:

  • Content that is Illegal
  • Content that is abusive, sexual or pornographic
  • Content that is violent or encourages violence
  • Content that threatens or harasses or encourages others to do so
Data Ownership
To give you the best customer experience, Flexie respects your right to own content created or stored by you. Whenever you create or store content through our platform, you retain its ownership. Flexie shall not use, modify, reproduce, publish or distribute content created or stored by you, unless you give us prior written permission to do so.
Data Processing Addendum
As a Flexie CRM customer any Personal Information as defined in the Data Processing Addendum that is subject to the GDPR  as defined in the Data Processing Addendum, on your behalf, in the provision of the Service, the terms of the data processing addendum or (DPA), that are incorporated by reference, shall apply and the parties agree to comply with those terms. When you are the data exporter, your agreeing to these Terms of Service shall be treated as signing of the DPA.
Spamming and illegal activities
By using our services, you understand that you are the sole responsible for the content you generate through the use of our services. As such, you shall not use Flexie for the transmission of content that is abusive, harmful, threatening, harassing, obscene, defamatory, vulgar, or if it promotes racism, infringes intellectual property, contains malicious code or viruses, and any other material that is otherwise objectionable. By agreeing to use our Terms of Service, you agree not to use Flexie for spam, junk mail, phishing or any type of unsolicited email. We may, in our discretion, terminate your access to the User account if there are reasonable grounds to believe that you have used Flexie for spamming or illegal activities.
The following spamming activities are prohibited, and may lead to the termination of your user account:
  • Manipulate or falsify identifiers such as domain names or email headers in order to hide the real origin of content transmitted through our platform
  • Use bots to collect email addresses from our site to send unsolicited or unauthorized material to third party users
  • Post, email, upload, or transmit the same message or URL multiple times
  • Rely email from a third party’s mail serves without having prior written permission by that third party
We have a strong Anti-Spam policy. In order to getting involved in any kind of spamming activity, bear in the mind the following:

  • Before you send email to third party users, you should have permission to contact that person on the subject of your email
  • You shall not use subject lines that might mislead the recipient of the message
  • You cannot import or send messages to email addresses that you might have rented, loaned or bought from a third party, regardless of any claim about permission while using our platform
  • You must make sure that the “From” and “To” are true and accurate
If we detect that you are being involved in any kind of spamming activity, we own the right to suspend or terminate your user account immediately without any prior notice.
User generated content
We respect your right to publish or transmit contented generated by you through our services. You understand that you are the sole responsible for publishing and transmitting such content. Any content you decide to make public can be accessed by anyone and it may be crawled by third party individuals or companies. If you accidentally make private content become publicly available, you shall be the sole responsible for it. If you receive content of other user of our platform, you agree not to reproduce, copy, display, sell, distribute or publish it without prior written permission by the person who owns the content. Any time there is a copyright infringement or complaints from other users of our platform, Flexie has the exclusive right to remove such content or block access to it.
Termination and suspension
We may suspend or terminate your user account without prior notice if there is any suspected illegal activity, requests from law enforcement authorities, or if you haven’t accessed your user account for an extended period of time. Flexie can also terminate your user account on your request. We can suspend or terminate your user account if there is proof beyond reasonable doubt that you have violated our Terms of Service. You have the right to terminate you user account if Flexie breaches these Terms of Service. Once your user account is terminated, you shall no longer have access to it and all your contact information will be deleted.

Furthermore, we have the right to terminate your user account if you fail to make service payments on time.
Refunds
If asked, we can execute a full refund within 30 days from your initial payment. You can get a full refund with no questions asked. In such cases please contact our support team from within Flexie CRM, or just by writing an email to .support@flexie.io. After 30 days from your initial payment, no refunds will be issued, you have to double check if everything works for you within the 30-days period of time.

Please note that after issuing the refund, your Flexie account would be terminated and canceled immediately.
Trademark
Flexie, Flexie logo and the names of specific services are all trademarks of Flexie. You agree not to copy, use, distribute or publish our Flexie trademarks without a prior written permission.
Warranties and Disclaimers
We do our best to offer an amazing service and a great customer care, but there are things we can’t promise about our platform:

OTHER THAN SPECIFICALLY DESCRIBED IN THIS TERMS OF SERVICE STATEMENT, NEITHER FLEXIE SOLUTIONS, NOR ITS PARTNERS, VENDORS AND OTHER CONCERNED THIRD PARTIES, MAKE ANY PLEDGE ABOUT THE SITES. FOR INSTANCE, WE DO NOT MAKE ANY COMMENT ABOUT THE CONTENT WITHIN THE SITES, THE SPECIFIC FUNCTION OF THE SITES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. FLEXIE SOLUTIONS MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE.

USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL.
Liability for our Services
YOU ACKNOWLEDGE THAT THE USE OF FLEXIE SOLUTIONS IS ENTIRELY AT YOUR SOLE RISK. BY ACCEPTING OUR TERMS OF SERVICE, YOU AGREE THAT FLEXIE SOLUTIONS SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF FLEXIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
Changes to our Terms of Service
We may, from time to time, in our discretion, make changes to our Terms of Service to ensure that you get the best possible service. You understand that receiving feeds and updates from Flexie is an integral part of using our services.

Whenever we modify our Terms of Service, you will be notified by an email to your primary email address. If there is any major change to our Terms of Service, you will be notified 30 days in advance through an email to your main email address. If you want to terminate your use of our Terms of Service, then please notify Flexie at least 30 days in advance so that we may take the necessary steps to close your account.

By continuing to use our Terms of Service, you acknowledge and comply with the changes. You may opt out from receiving newsletters from Flexie with regard to certain types of content, but you shall receive administrative messages and announcements about new services. This is to ensure that you get the best possible customer experience.
